Act 26 of 1998
Act 26 sets the maximum fees that can be charged for medical records. These fees are updated yearly through the Department of Health. With a few exceptions, the maximum fees for a record request from a patient or attorney for 2003 are as follows:
searching and retrieving the record - $16.94
pages 61 and after - $.29 per page
pages 1 through 20 - $1.13 per page
copies from microfilm - $1.68
pages 21 through 60 - $.85 per page
actual mailing or delivery fees

The Secretary provides notice that, effective January 1, 2005, the following payments may be charged by a health care facility or health care provider for production of records in response to subpoena or request:
Amount charged per page for pages 1--20: Not to Exceed $ 1.17
Amount charged per page for pages 21--60: Not to Exceed $ .88
Amount charged per page for pages 61--end: Not to Exceed $ .30
Amount charged per page for microfilm copies: Not to Exceed $ 1.73
Search and retrieval of records: Not to Exceed $17.48
